1. Acceptance of Terms

By accessing or using Certack (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Service Description

Certack is an infrastructure monitoring platform that provides SSL certificate monitoring, DNS record monitoring, domain expiry monitoring, incident management, MCP/AI integration for automated workflows, white-label status pages, and team collaboration features. The Service includes automated insights, alert notifications, and a dashboard for managing monitored resources. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

3. User Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring that the domains and URLs you monitor are ones you have authorization to monitor
  • Notifying us immediately of any unauthorized use of your account
  • Complying with all applicable laws and regulations

4. Acceptable Use

You agree not to:

  • Use the Service to monitor domains or infrastructure you do not own or have permission to monitor
  • Attempt to overwhelm or abuse our monitoring infrastructure
  • Use the Service for any illegal or unauthorized purpose
  • Share your account access or use it across multiple accounts
  • Reverse engineer, decompile, or disassemble any part of the Service

5. Payment and Billing

Paid plans are billed through our payment provider, Creem. By subscribing to a paid plan, you agree to Creem's terms of service and payment processing policies. Subscription fees are billed in advance on a monthly or yearly basis, depending on your selected plan. Yearly billing is available at a discounted rate. Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. Prices are subject to change with 30 days' advance notice; price changes will apply to the next billing cycle after notice is given.

6. Account Access and Activation

When you purchase a paid plan, access is activated on your Certack account once payment is confirmed. Paid plan access is non-transferable and tied to your account. You may not sell, share, or otherwise transfer access to your account. We reserve the right to revoke access that is used in violation of these Terms. Separate software products sold with license keys are delivered and managed by our payment provider, Creem, under its own terms.

7. Service Availability

We strive to provide a reliable and available service, but we do not guarantee uninterrupted access. The Service is provided “as is” and “as available.” Scheduled maintenance windows will be communicated in advance when possible.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Certack and are protected by international copyright, trademark, and other intellectual property laws. Your monitoring data and configuration remain your property. You grant us a limited license to process and store this data solely for the purpose of providing the Service.

9. Limitation of Liability

To the maximum extent permitted by law, Certack shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of or inability to use the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Certack and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, expenses (including reasonable attorneys' fees), and liabilities arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another party. Certack reserves the right to assume exclusive defense of any matter subject to indemnification by you, and you shall not settle any such matter without our prior written consent.

11. Force Majeure

Neither party shall be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, civil unrest, epidemics, pandemics, government actions, labor disputes, power outages, internet disruptions, or failures of third-party service providers. If a force majeure event continues for more than 60 days, either party may terminate these Terms upon written notice.

12. Data Breach Notification

In the event of a data breach that affects your personal data, Certack will notify affected users within 72 hours of discovering the breach, in accordance with applicable data protection laws. Notification will be sent to the email address associated with your account and will include a description of the breach, the types of data affected, and the steps we are taking to mitigate the issue. We will also provide guidance on any actions you can take to protect yourself.

13. Third-Party Links and Services

The Service may contain links to or integrations with third-party websites, services, or tools that are not owned or controlled by Certack. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party services. Your interaction with third-party services is governed solely by their respective terms and policies. The inclusion of any link or integration does not imply our endorsement. Certack shall not be liable for any damage or loss caused by or in connection with the use of any third-party content, goods, or services.

14. DMCA / Copyright

Certack respects the intellectual property rights of others and expects its users to do the same. If you believe that any content on or accessible through the Service infringes your copyright, you may submit a notification of claimed infringement to our designated copyright agent. Your notice must include: (a) a physical or electronic signature of the copyright owner or authorized representative; (b) identification of the copyrighted work claimed to have been infringed; (c) identification of the infringing material and its location on the Service; (d) your contact information; (e) a statement that you have a good faith belief that the use is not authorized; and (f) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the copyright owner. 15. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we determine, in our sole discretion, violates these Terms or is harmful to other users, us, or third parties. You may terminate your account at any time by deleting it through the dashboard or contacting us. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall remain in effect.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree with the changes, you must stop using the Service.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved first through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association, held in Wilmington, Delaware. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent irreparable harm.

18. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms. The remaining provisions shall continue in full force and effect, and the invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the intent of the original provision.

19. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference herein, constitute the entire agreement between you and Certack regarding the use of the Service. These Terms supersede all prior or contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service.

20. Waiver

The failure of Certack to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Certack. The waiver of any right or provision hereunder shall not be construed as a waiver of any other right or provision.

21. Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. Certack may assign its rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of all or substantially all of our assets. Any attempted assignment in violation of this section shall be void.

22. Export Compliance

You may not use the Service if you are located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country. You may not use the Service if you are on any list of prohibited or restricted parties maintained by the U.S. Government, including the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Commerce Department's Denied Persons List or Entity List. You agree to comply with all applicable export and re-export restrictions, orders, and regulations, including the Export Administration Regulations (EAR), the International Traffic in Arms Regulations (ITAR), and any sanctions programs administered by the Office of Foreign Assets Control (OFAC).

23. Age Requirement

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you are at least 16 years old. If you are under 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly collect personal information from children under 16. If we become aware that we have collected personal data from a child under 16, we will take steps to delete such information promptly.
